These Terms & Conditions ("Terms") govern your access to and use of this website and all services offered by Samman Tiranga Foundation ("Samman Tiranga", "we", "us" or "our"), including the Flag Exchange programme, donations, membership, events, the online shop and all other content.
Please read these Terms carefully. By accessing or using this website you confirm that you accept them and agree to be bound by them. If you do not agree with any part of these Terms, you must not use this website or our services.
1. About Us and These Terms
Samman Tiranga Foundation is a not-for-profit organisation working to promote respect for the National Flag of India. Our registered address is K-18-B, Ground Floor, Sheikh Sarai-II, New Delhi – 110017, India.
These Terms apply to every visitor and user of the website. Additional terms may apply to specific services (such as membership or purchases from our shop); where there is a conflict, the specific terms for that service prevail for that service only.
We may update these Terms at any time. The revised version takes effect when published on this page, and the 'Last updated' date above will change. Your continued use of the website after publication constitutes acceptance of the revised Terms.
2. Not a Government Body
Samman Tiranga Foundation is an independent, non-governmental, not-for-profit organisation. We are not a department, agency, instrumentality or authorised representative of the Government of India, of any State Government, of the Ministry of Culture, of the Bureau of Indian Standards (BIS), or of any other statutory or regulatory authority.
Nothing on this website should be read as an official government communication, endorsement, certification or approval. Any reference to government bodies, standards, campaigns or officials is descriptive and informational only and does not imply affiliation, sponsorship or endorsement in either direction.
If you require an authoritative or official position on the National Flag, please refer directly to the Flag Code of India, 2002 and the relevant statutes, or contact the appropriate government authority.
3. Information Is Not Legal Advice
The material on this website about the Flag Code of India, 2002, the Prevention of Insults to National Honour Act, 1971, the Emblems and Names (Prevention of Improper Use) Act, 1950 and related matters is provided for general awareness and educational purposes only.
It is a summary written in plain language, it may be simplified or incomplete, and laws and official guidance change over time. It does not constitute legal advice and must not be relied upon as such.
You should not act, or refrain from acting, on the basis of anything on this website without obtaining your own independent professional or legal advice appropriate to your circumstances. We accept no liability for any action taken or not taken in reliance on this content.
4. Eligibility and Acceptable Use
You must be at least 18 years old, or be using the website under the supervision of a parent or legal guardian who agrees to these Terms on your behalf, in order to submit forms, make donations or place orders.
You agree to use this website only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of it.
- Do not submit false, misleading, fraudulent or impersonating information through any form on this website.
- Do not attempt to gain unauthorised access to any part of the website, its servers, databases, or any system or network connected to it.
- Do not probe, scan, test the vulnerability of, or breach the security or authentication measures of the website without our prior written permission.
- Do not use automated systems (bots, scrapers, crawlers) to extract data, place orders or submit forms, except for well-behaved search engine crawlers obeying our robots.txt.
- Do not introduce viruses, trojans, worms, logic bombs or any other malicious or technologically harmful material.
- Do not use the website or our name for any activity that is unlawful, defamatory, obscene or harassing, or that would bring the National Flag or this Foundation into disrepute.
- Do not overload, flood, spam or otherwise interfere with the proper working of the website or the delivery of our services.
We reserve the right to refuse service, remove content, block access, and report conduct to the relevant law enforcement authorities where we believe, acting reasonably, that a breach of these Terms has occurred.
5. The Flag Exchange Programme
Our Flag Exchange programme allows members of the public to submit a damaged, torn, faded or soiled National Flag for respectful retirement, and to receive a replacement flag. Participation is subject to these Terms and to the following conditions.
- Submitting a request does not create a binding contract or a guarantee of service. All requests are subject to verification, availability of stock, our operational capacity and geographic serviceability.
- We may decline any request at our discretion, including where the item submitted is not a National Flag, where the request appears fraudulent or abusive, or where we are unable to service your location.
- Timelines quoted anywhere on this website are good-faith estimates only and are not guarantees. Delays may arise from logistics partners, weather, public holidays or circumstances beyond our control.
- By submitting a flag to us, you confirm that you are its lawful owner or are authorised to dispose of it, and you transfer it to us for the purpose of respectful retirement.
- Flags submitted to us are retired and cannot be returned. Please remove and retain anything of personal or sentimental value attached to a flag before handing it over.
- Replacement flags are provided free of charge as a goodwill gesture and are subject to availability. We do not guarantee a specific size, material or manufacturer.
- You are responsible for the accuracy of the pickup address and contact details you provide. We are not liable for failed collection resulting from incorrect details or from nobody being available.
Your tracking code is confidential. Anyone who has it can view the status of your request. Please do not share it publicly or post it online.
6. Donations
Donations made through this website support our programmes and general charitable work. By donating you confirm that the funds are lawfully yours and that the payment method used belongs to you or is used with the account holder's authority.
- Donations are voluntary and, save as set out in our Refund Policy, are non-refundable once processed.
- We allocate donations at our reasonable discretion towards our charitable objectives. Unless a specific written restriction has been agreed with us in advance, donations are treated as unrestricted general funds.
- Any statement about the proportion of funds applied to programmes is indicative and made in good faith; it is not a contractual guarantee applicable to each individual donation.
- Where a receipt or tax-exemption certificate is available, it will be issued in accordance with applicable Indian law and subject to our registration status at the time of the donation.
- We make no representation or warranty that any particular donation will qualify for a tax deduction. You should confirm your own tax position with a qualified tax adviser.
7. Membership
Annual membership is offered at the fee stated on the membership page at the time of purchase. Membership benefits are described on that page and may be varied, substituted or withdrawn by us on reasonable notice.
Membership is personal to the member, is not transferable, and does not confer any ownership interest, voting right, management right, or any right to direct the affairs of the Foundation.
Membership runs for twelve months from the date of successful payment unless stated otherwise, and does not renew automatically unless you are told so at the point of purchase.
We may suspend or terminate a membership without refund where the member breaches these Terms or acts in a way that is harmful to the Foundation, its volunteers, its beneficiaries or the dignity of the National Flag.
8. Shop, Orders and Pricing
Products listed in our shop are an invitation to treat, not an offer. Your order is an offer to purchase, and a contract is formed only when we confirm dispatch of the item.
- All prices are in Indian Rupees (INR) and inclusive of applicable taxes unless stated otherwise. Shipping charges, where applicable, are shown before you complete checkout.
- Order totals are always calculated on our server from our own records. Where a price, total or stock level displayed to you differs from our records due to a technical error, our server-side figure governs.
- We reserve the right to correct pricing errors, to limit order quantities, and to cancel and refund any order affected by an obvious error, even after payment has been taken.
- Product photographs and descriptions are indicative. Colours may vary between screens, and handmade or khadi items naturally vary in weave, shade and finish.
- Risk in the goods passes to you on delivery. Title passes on receipt of payment in full.
9. Payments
Payments on this website are processed by Razorpay, a third-party payment gateway. We do not receive, process or store your full card number, CVV, UPI PIN, net-banking credentials or any other complete payment instrument details on our servers.
Your use of the payment gateway is additionally subject to that provider's own terms and privacy policy. Any dispute concerning the processing of a payment by the gateway may need to be raised with that provider.
We are not liable for losses arising from the failure, downtime, delay or error of a payment gateway, bank, card network or UPI service, except to the extent such liability cannot be excluded by law.
If you believe a payment has been taken in error or without your authority, contact us immediately using the details at the end of this page, and also notify your bank or card issuer.
10. Intellectual Property
Unless otherwise stated, the content of this website — including its text, layout, design, graphics, logos, wordmarks and compilations — is owned by or licensed to Samman Tiranga Foundation and is protected by Indian and international copyright and trade mark law.
You may view, download and print pages from this website for your own personal, non-commercial use, and you may share links to it freely. You may not otherwise reproduce, republish, adapt, distribute, sell or commercially exploit any part of it without our prior written consent.
Our name, logo and marks may not be used to imply endorsement, partnership or affiliation, or in any manner likely to cause confusion, without our prior written permission.
The National Flag of India, the Ashoka Chakra and the State Emblem are national symbols governed by Indian law. Nothing on this website grants you any right in them, and their use is restricted by statute regardless of anything stated here.
11. Third-Party Content, Images and Links
This website may include photographs, illustrations, quotations, historical material, and links to third-party websites and embedded services such as maps.
Third-party material is used for informational, educational and illustrative purposes. Some imagery may be stock, licensed, illustrative, digitally created or representative rather than a documentary photograph of a specific real event, person or place.
Where material is attributed to a third party, all rights remain with the respective owner. Links to external websites are provided for convenience only; we do not control, endorse or accept responsibility for their content, accuracy, availability, privacy practices or security.

We take such notices seriously and will review and, where appropriate, promptly remove or correct the material.
12. User Submissions
Where you submit content to us — for example a story, photograph, testimonial, review or comment — you confirm that it is your own original material or that you have all necessary rights to submit it, and that it does not infringe anyone else's rights.
You grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, edit for length and clarity, publish and display that content in connection with our charitable work, including on this website, in reports and on our social channels. You retain ownership of your content.
We are not obliged to publish any submission, and we may edit, decline, remove or withdraw any submission at any time without giving reasons.
Please do not send us confidential information, and do not submit personal details or photographs of other identifiable individuals without their consent.
13. Availability and Accuracy
We aim to keep this website available and its content accurate and up to date, but we give no warranty or guarantee that it will be uninterrupted, error-free, secure, free of viruses, or that defects will be corrected.
Statistics, impact figures, timelines and programme details are provided in good faith and may be approximate, rounded, indicative or subject to revision.
We may suspend, withdraw, discontinue or change all or any part of the website, or any service offered through it, without notice and without liability to you.
The website and all services are provided on an 'as is' and 'as available' basis. To the maximum extent permitted by law, we exclude all representations, warranties and conditions whether express or implied.
14. Limitation of Liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under applicable Indian law.
Subject to the above, and to the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, punitive or consequential loss or damage, nor for any loss of profits, revenue, business, goodwill, opportunity, data or anticipated savings, arising out of or in connection with your use of this website or our services, whether in contract, tort (including negligence), breach of statutory duty or otherwise.
Subject to the above, our total aggregate liability in respect of all claims arising out of or in connection with these Terms, the website or our services shall not exceed the greater of (a) the total amount actually paid by you to us in the twelve months preceding the event giving rise to the claim, or (b) INR 5,000.
You acknowledge that our services, including the Flag Exchange programme, are provided on a charitable, no-cost or subsidised basis, and that this limitation of liability is a reasonable allocation of risk in that context.
15. Indemnity
You agree to indemnify, defend and hold harmless the Foundation, its trustees, officers, employees, volunteers and agents from and against all claims, demands, proceedings, losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of or in connection with your breach of these Terms, your misuse of the website, your infringement of any third-party right, or any content you submit to us.
16. Force Majeure
We shall not be in breach of these Terms, nor liable for any delay or failure to perform, where that delay or failure results from events beyond our reasonable control. This includes acts of God, natural disasters, floods, fire, epidemic or pandemic, war, civil unrest, terrorism, strikes, government action or restriction, failure of public infrastructure, power or telecommunications outage, internet or hosting failure, and failure of couriers, banks or payment gateways.
17. Privacy and Data Protection
Our collection and use of your personal data is described in our Privacy Policy, which forms part of these Terms. Please read it to understand what we collect, why we collect it, how long we keep it, and what rights you have under the Digital Personal Data Protection Act, 2023.
18. Suspension and Termination
We may suspend or terminate your access to the website or to any service, in whole or in part, immediately and without notice, where we reasonably believe you have breached these Terms or where suspension is necessary to protect the website, our users, our volunteers or our beneficiaries.
Termination does not affect any rights, remedies, obligations or liabilities that have accrued up to the date of termination. Clauses that by their nature should survive termination — including intellectual property, limitation of liability, indemnity and governing law — shall continue in force.
19. Grievance Redressal
In accordance with the Information Technology Act, 2000 and the rules made under it, complaints regarding content on this website or your use of it may be addressed to our Grievance Officer.

We will acknowledge your complaint within 24 hours of receipt and endeavour to resolve it within 15 days, or such other period as may be required by applicable law.
20. Severability, Waiver and Entire Agreement
If any provision of these Terms is held to be invalid, unlawful or unenforceable by a court of competent jurisdiction, that provision shall be severed and the remaining provisions shall continue in full force and effect.
No failure or delay by us in exercising any right or remedy under these Terms shall operate as a waiver of it, and no single or partial exercise shall prevent any further exercise.
These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy and Disclaimer, constitute the entire agreement between you and us in relation to your use of this website.
21. Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them, their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of India.
The courts and tribunals at New Delhi, India shall have exclusive jurisdiction to settle any such dispute or claim.
